1. General:
1.1. All references to “we” and “us” in the following terms and conditions refer to items for sale by eBay user dark_streets4, on eBay.co.uk or eBay.com
1.2. All items for sale are brand new.
1.3. Before you consider leaving any feedback other than positive, please contact us to give us the opportunity of resolving any issues you may have with you order. Please be assured, we will do everything possible to ensure you experience a successful transaction.
1.4. Despatch of items:
1.4.1. Royal Mail: We endeavour to dispatch items within 24 hours of receipt of cleared payment, except during weekends and UK bank holidays. However on most weekdays, items will be despatched the same day if cleared payment is received before 1500 hrs.
1.4.2. Courier: Items for which cleared payment is received before 21:00 hrs will normally be dispatched the next day. Delivery takes 1 -2 working days. The courier rates apply to the UK mainland only, excluding the Scottish Highlands.
For postal rates to any part of the UK not covered, or if you have a specific delivery request, please contact us, as other services are available.
1.4.3. VAT is included in all prices where relevant. A VAT receipt can be issued upon request
2. Payment:
2.1. We accept UK postal orders, UK cheques and all forms of PayPal payments. Please note that we will wait until payments are cleared, where relevant, before issuing items. Please note that, in our experience, PayPal eCheques normally take 10 days to clear.
2.2. Payments should be made within 7 working days from the purchase date. If you are not using PayPal as your payment method, please include with your payment, your eBay user I.D, Item Number(s), and colour of item(s), (if applicable).
2.3. Important information for non-UK Buyers:
2.3.1. Non-UK buyers should pay via PayPal. However, if an alternative payment method is desired, then we may be able to accommodate you, but, you MUST contact us via email BEFORE sending the payment, as not all other non-UK non-PayPal payment methods are acceptable.
3. Colour Choices:
3.1. Item listings that require the buyer to request a choice of colour(s), will be clearly identified within the body of the listing, with instructions on how to specify the colour choice(s).
3.2. If the buyer does not make any colour choice(s), or their colour choice(s) are not available, at the time of purchase, then we will send one email to the buyer’s eBay registered email address to request their colour choice(s).
3.3. If the buyer has not responded with an indication of their colour choice(s) within 72 hrs of being sent the email referred to in 3.2 above, then a random choice of colour(s) will be despatched.
3.4. If the buyer is not happy with the random colour choice(s) referred to in 3.3, then they can opt to return the item(s) in question in accordance with section 4.1 below.
4. Returns
4.1. Contract Cancellation: You have the right to cancel the contract for the purchase of any items within a period of 7 working days, beginning with the day after the day on which the item is delivered. However, this contract cancellation does not apply to DVD’s where the outermost seal/wrapping has been broken and does not apply to Magazines
4.1.1. If you wish to return item(s) under the terms of 4.1 above, then the items must be unused, in their original packaging, with all relevant seals attached and unbroken, and, in the case of clothing, with all original tags and labels attached. The item(s) must be sent to us so that we receive them within 7 working days after the day of the date that the item(s) were delivered to you. For your protection, we recommend that you use a recorded-delivery service. Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error or the item is damaged on receipt, (see 4.2 below).
4.2. Wrong/Damaged items:
4.2.1. Wrong item(s): If we send a wrong item or items to the buyer, then they can be returned for replacement or refund at the buyer’s discretion. We will refund the postage costs associated with the return of the item(s). The buyer must contact us with details of the item(s) received BEFORE returning the items to us. Any items to be returned to us must comply with the item condition description given in 4.1.1 above.
4.2.2. Damaged item(s): We take great care in the packaging of all our items, but in the unlikely event the buyer receives item(s) damaged in transit, we will replace the item(s) at no further cost to the buyer. The damaged item(s), and all associated packaging, will have to be returned to us before we issue the replacements. The postage cost associated with the return will also be refunded by us. Please contact us BEFORE returning the item(s) to discuss the method of return. If it is impractical to return the damaged item(s), then we would require photographic evidence of the damage to be forwarded to us before we issue replacements.
5. Proof of Posting/Postal issues:
5.1. A proof of posting is obtained for all packages sent, a copy of which can be forwarded to the buyer on request. We are not responsible for any packages lost or delayed in the postal/courier system.
5.2. For packages deemed lost in the Royal Mail postal system, we will be happy, on behalf of our customers, to complete the relevant forms for the Royal Mail investigation into the loss. Please note, however, these investigations can take a considerable time to be completed.
6. Other:
6.1. We reserve the right to amend these Terms and Conditions at any time.
