The fact that others are selling products that infringe HEL Performance Products intellectual property rights does not give you the right to do so. Similarly, the fact that a product is being sold on eBay is in no way a guarantee that it is a genuine, authorised HEL Performance Product.
It is legal to re-sell a genuine HEL Performance product that you purchased, in its original and unaltered form, in the territory in which you bought it, and you may use HEL Performance trade marks to describe such items.
However, you should be aware that selling outside the territory in which you bought the item could be illegal as certain countries have laws prohibiting unapproved parallel trading. For example, items offered for sale to European countries which have not first been put on the market by HEL Performance within the European Economic Area ("EEA") by HEL Performance may infringe HEL Performances rights.
HEL Performance does not produce product for any other company - any such item will be deemed counterfeit.
Keyword Spamming And User Identities (id's)
It infringes HEL Performances right to advertise goods using HEL trade marks when advertising goods for sale that are not HEL related goods or to use HEL trade marks as part of a user’s id.
Sellers, have a responsibility to ensure that their actions do not violate the intellectual property rights of HEL Performance. Ignorance that it is a violation of any country's trade mark, design right, patent or copyright law is no excuse.
