As I only sell genuine legally produced DVDs obtained directly from the producing companies including - Simply Home Entertainment who took over the original distribution rights holders business last year which was DD Home Entertainment (which went into administration August 2007) and the product carries the logos of either or both companies. I do not condone and actively strive to eliminate all infringements of copyright as the continued selling of these naff products will ultimately destroy the ability of sellers such as myself to be able to obtain and therefor supply the correct and legal product. Sorry to go on so but your question touch a bit of a nerve with me as eBay seem to allow the illegally produced home DVDs by sellers who claim they are in the Public Domain and since there is no way these no marks could ever get their hands on the original celluloid negatives, they are copying material which has been produced, then revised, then changed from one set of master tapes (BETAMAX Masters) for TV transmission, altered to fit the time cycle allowed by TV Companies and the differences of the PAL & NTSC television systems which operate at completely different frames per second and finally digitalised for ease of storage and release on modern media by the legitimate rights holders. 

So basically even if the original work is now in the public domain - to sell home-produced DVDs or to sell counterfeits supplied in plastic sleeves (to save costs so they say) as such is illegal unless the producers owns the right to do so as the original medium (film stock as produced at the time) must be owned and not a file transfer copy from a broadcast or someone elses work, the use of file transfers is illegal and as reported in the media recently to download or subsequently sell such material is being actively prosecuted (for music downloads at the moment and the studios will also be applying such sanctions against the illegal production and file sharing of their copyrighted material.) For an item to be in the Public Domain it needs to be out of copyright but you would need to physically have the film negative and do all the transfer onto modern media yourself otherwise, if you are using material taken from other producers work such as a the rights-holding studios transfers onto first BetaMax masters from the seventies onwards and now those masters in their altered format (primarily to accommodate television broadcast requirements) are now transferred onto digital storage media and then onto masters for production. So people claiming to be acting within the law are wrong and will eventually be stopped from doing so - eBay is at fault in this matter as it is their responsibility to stop such abuse and for which they have just been fined in France for allowing in essence the same type of rip-off to occur for fake designer goods - sorry to go on so but it really annoys me as if not stopped all these older films will cease to be legally produced by the studios and a source of genuine articles will be lost  forever. eBay must really get their act together on this as every infringement reported goes unanswered and is never acknowledged by eBay. To buy or sell such material can lead to prosecution and confiscation of equipment used to purchase or play - your internet provider may well withdraw their service - so please contact you local trading standards office to get the real facts as to your legal liability as it could be I am biased as I only sell genuine licenced items for which I pay
